A check of Kabacum North-2 beach has been done by the National Construction Supervision Directorate control

A check of the National Construction Supervision /NCS/ Directorate Varna (Regional office „NCS”-Varna) for Kabakum North-2 beach has finished. It has been ordered by the Minister of regional development and public works Lilyana Pavlova. It has been ascertained in a protocol that:

„During an inspection at site: Fitness club-56 m2, located on Sea beach “Kabakum-north -2”, Varna, part of the sea cost, no changes have been observed since the last checks.   The concessionaire representative was not present. A mobile notice board was observed, placed along a path near the fitness club saying it is a private club. Site: The fitness club was closed during the check. 

It is ascertained that the fitness club is completed in compliance with the architecture part of the design and scheme and has two floors with total floorage of about 112 square meters, instead of 56 square meters, which is a diversion of the special scheme approved by the Chief architect of Varna Municipality, after being approved by the Ministry of regional development and public works by letter ref. 70-00-3731/18.01.2011. Its structure is entirely metal, placed on an iron grid on the beach , not connected to the terrain/ascertained during last check/.No concrete bases and structures are made and so it can not be considered as a site according to §5, p.38 the Additional regulations /AR/ of the Territory development Act /TDA/. The RO „NCS”-Varna has no control functions to apply a Regulation of the municipal council”.

Under a request of the Minster of regional development the RO of NCS sent information to the mayor to Varna municipality to order the removal of the second floor (of the second level) of the site „Fitness club”. Lilyana Pavlova shall be kept posted about the undertaken actions. In a letter RO NCS an urgent check has been requested by the Commission for protection of consumers and it will concern the site’s usage. The reason is that the site is “for public use” according to the concession agreement and not a “private club”.

Minister Pavlova is expecting the results of the mayor’s activity and the check of the Commission for the consumers’ protection.
