Whistleblowing under the RRP
We would like to inform you that any person has the right to report irregularities and fraud arising in connection with the implementation of projects under the Recovery and Resilience Plan.
"Irregularity" means any infringement of a provision of Community law resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the Communities or budgets managed by them, either by reducing or losing revenue accruing from own resources collected directly on behalf of the Communities, or by an unjustified item of expenditure.
Alerts may concern technical, financial or administrative irregularities, those related to signed grant contracts or contracting, etc. The circumstances set out in your alerts will be checked and, if their accuracy is confirmed, the necessary measures will be taken, depending on the specifics of each case. Whistleblowing is possible through the alert buttons installed in all administrations managing European funds on the website of the respective administration. Alerts can also be submitted orally, in writing and by e-mail. The general framework for the submission and examination of alerts is contained in Chapter 8 of the Code of Administrative Procedure (APK).
Article 108(2) of the APK contains the principle of protection of whistleblowers, namely that no one may be prosecuted for having reported.
Alerts shall be processed in compliance with the obligation of confidentiality arising from Articles 31 and 32 of the ZZLPSPOIN. Personal data that is clearly not relevant for the examination of the specific alert shall not be collected and, if accidentally collected, shall be deleted (Article 32(2) of the ZZLPSPOIN).
Submission of written alerts on an irregularity
If you have information about an irregularity, please send it to e-mail signalipvu@mrrb.government.bg, and in the signal it is desirable to indicate the following:
1. name of the sender;
2. a description as detailed as possible of the irregularity observed;
3. the number of the contract, the name of the applicant or beneficiary (if possible);
4. telephone number (if possible) to use if necessary to clarify some of the information submitted by you. Providing or not providing a contact telephone will not affect the conduct of the case check, but the possibility of feedback will allow a more precise clarification of the circumstances.
