SAC repudiated a claim against the amendments in Ordinance N_ 7

A five-member jury of the Supreme Administrative Court (SAC) repudiated as groundless the claim made by arch. Julian Dimitrov Macedonsky against the amendments in Ordinance N_ 7 for rules and regulations on the separate types of territories and planning zones. Arch. Macedonsky’s claim was against the written in 2005 new chapter in the Ordinance – twelfth “a” on “Black sea coastline planning”. According to SAC the Ordinance and its amendments do not contradict the provision of Article 13, Paragraph 1 from the Law of the Spatial Planning and to the forthcoming endorsement of a separate law according to which the Black sea coastline can acquire the status of a territory with special territorial planning protection.
