Functions of the Directorate:
1. Provides procedural representation of the Minister, the Ministry and the State under the conditions of Article 31(2) of the Civil Procedure Code before judicial, arbitral and administrative authorities.
2. Analyses and summarises the status of cases brought by and against the Ministry.
3. Analyses case law on the application of administrative acts related to the activities of the Ministry and makes proposals for their improvement or proper application.
4. Provides opinions on the legal grounds for the enforcement of final court decisions.
5. Undertakes the necessary legal actions for the collection of receivables owed to the Ministry.
6. Provides legal assistance to the management and structural units of the Ministry in order to ensure the lawful exercise of their functions.
7. Issues opinions on the compliance of draft normative acts with the achievements of European law.
8. Prepares opinions on constitutional cases in which the Minister is an interested party.
9. Issues opinions on the legality of draft contracts concluded by the Ministry.
10. Issues opinions on the issuance of binding instructions and the imposition of coercive administrative measures, and monitors the lawful conduct of proceedings for the imposition of such measures.
11. Issues opinions on draft acts through which the Minister exercises the State’s ownership rights in the capital of commercial companies.
12. Issues opinions on the legality of draft individual administrative acts issued by the Minister.
13. Issues opinions on the legality of procedures under the State Property Act, the Concessions Act, the Civil Servant Act, the Labour Code and other applicable legislation conducted within the Ministry.
14. Monitors the legality of procedures related to the establishment, amendment and termination of employment and civil service relations.
15. Participates through its representatives in working groups for the drafting of laws and secondary legislation.
16. Participates in the drafting process and provides opinions on the legality of draft normative acts issued by the Minister within his/her competence.
17. Provides opinions on draft normative acts or international treaties submitted by other state authorities for coordination.
18. Participates in the examination of claims submitted under the Compensation of Owners of Nationalised Property Act (CONPA).
19. Prepares draft decisions granting or refusing access to public information under the Access to Public Information Act, based on a reasoned opinion provided by the relevant directorate regarding the availability and nature of the information.
20. Prepares opinions on legal matters raised by citizens and legal entities in relation to the activities and functions of the Ministry.
21. Provides legal assistance to the Minister in the exercise of his/her powers in relation to subordinate budget spending units.
