State Property and Commercial Companies Directorate:

1. Assists the Minister in the development of a policy on the management and disposal of state-owned property and in the implementation of methodological guidance in the management and disposal of state-owned property;
   2. Prepares draft strategies, concepts, national programs and action plans on property ownership issues;
   3. Develops draft normative acts related to state property, develops methodological guidelines on the application of normative acts related to state property;
   4. Controls and coordinates the registration and actuation of state-owned properties, such as:
2. a) Draw up acts for objects - exclusive state property, and keep a register for them;
3. b) Accepts the copies of the acts of the state-owned properties submitted by the regional governors, as well as information on their management and disposal in accordance with the requirements of Article 82, paragraph 1 of the State Property Act;
4. c) Write off from the deed books acts for properties - state property, for properties - public state property, as well as for properties related to the state secret or to the security and defense of the country, which have been drawn up incorrectly or whose grounds for deeding have been dropped;
5. d) (new - SG 31/19) adopts and keeps the acts for state property for properties, which are related to the security and defense of the country and are not marked with a security classification;
6. e) (new - SG 31/2019) adopts and stores the acts of state ownership for properties owned by the Bulgarian state outside the country;
7. Prepares proposals for management and disposal of state-owned property, such as:
8. a) Prepares draft acts of the Council of Ministers for granting free of charge the right to manage departments and municipalities over properties - state property, as well as for changing the nature of the ownership of properties - state property;
9. b) Prepare draft acts of the Council of Ministers for disposal of state-owned property or parts thereof;
10. c) organizes and conducts auctions for the establishment of limited real rights over properties - private state property, the tax assessment of which is over BGN 500,000;
11. d) prepare draft acts of the Council of Ministers for renting properties - state property, to the central management of the political parties and coalitions represented in parliament;
12. e) Prepares draft decisions of the Council of Ministers for expropriation of properties and parts of properties - private property, intended for the construction of national infrastructure projects;

    9. (new - SG 9/2023, in force from 27.01.2023) Organizes the implementation of the assigned tasks regarding the state participation in the commercial companies by carrying out methodological guidance on the issues related to the financial and economic situation, accounting and taxation;
    10. (new - SG 9/2023, in force from 27.01.2023) organize the preliminary preparation by order of the Minister for the acceptance of the annual financial statements for the respective calendar year of the commercial companies;
    11. (new - SG 9/2023, in force from 27.01.2023) ensure the participation of representatives of the state in the general meetings of the partners and of the shareholders in the commercial companies with more than 50 per cent state participation;
    12. (new - SG 9/2023, in force from 27.01.2023) organize the implementation of the assigned tasks regarding the acquisition and disposal of real estate, long-term tangible and financial assets of commercial companies, as well as the provision of real estate to departments and other state structures;
    13. (new - SG 9/2023, in force from 27.01.2023) prepare the contracts for management and control of the management and control bodies of the commercial companies with more than 50 per cent state participation and monitor the implementation of their rights and obligations;
    14. (new - SG 9/2023, in force from 27.01.2023) propose for approval by the Minister programmes for restructuring of the commercial companies - WSS operators, in which the state is the sole owner of the capital, and propose for approval by the respective general meetings programmes for restructuring of the commercial companies - WSS operators, with state participation in the capital;
    15. (new - SG 9/2023, in force from 27.01.2023) when drafting contracts for management and control of the management and control bodies of the commercial companies - water supply and sewerage operators, with more than 50 per cent state participation, determine the main indicators for the activities of the water supply and sewerage operators in accordance with the business plans approved by the Energy and Water Regulatory Commission and control their implementation;
    16. (new - SG 9/2023, in force from 27.01.2023) carry out processing of the financial statements of commercial companies with more than 50 per cent state participation, prepare an analysis - quarterly and annual, and submit it for information to the management of the Ministry and the Ministry of Finance;
    17. (new - SG 9/2023, in force from 27.01.2023) monitors, requests and analyses quarterly reports on the compliance of commercial companies with their net exposures to banking institutions and the requirements for concentration of their funds and provides information to the Ministry of Finance in accordance with the current regulatory framework;

(new - SG 9/2023, in force from 27.01.2023) perform the activities and coordinate the process of deregistration from the balance sheet of the commercial companies - water operators, with more than 51 per cent state participation, of property and assets - public state and/or public municipal property, according to the Water Act;
    19. (new - SG 9/2023, in force from 27.01.2023) coordinate the activity, organize and participate in the meetings of the branch council for tripartite cooperation and the related subsidiary consultative bodies and working groups;
    20. (new - SG 9/2023, in force from 27.01.2023) maintain and update a register of commercial companies with state participation in accordance with the regulations, as well as information on the management and control bodies and liquidators of commercial companies with more than 50 per cent state participation;
    21. (new - SG 9/2023, in force from 27.01.2023) keep and shall be responsible for the entire documentation of the dissolution transactions after their completion, for the documents received as means of payment and for the pawnbrokers and shall provide information to the Agency for Public Enterprises and Control, the authorities of the court, the prosecutor's office and the police - at their request;
    22. (new - SG 9/2023, in force from 27.01.2023) develop a policy for the participation of the state in public enterprises in cooperation with the Public Enterprises and Control Agency;
    23. (new - SG 9/2023, in force from 27.01.2023) participate in the preparation of an Annual Summary Analytical Report for public enterprises with regard to the companies from the MRDPW system together with the Public Enterprises and Control Agency;
    24. (new - SG 9/2023, in force from 27.01.2023) ensure the participation of representatives of the Ministry of Regional Development and Public Works in the Nomination Commission during the competitive procedures or conduct competitive procedures for selection of members of the management and control bodies in the public enterprises from the system of the Ministry of Regional Development and Public Works;
    25. (new - SG 9/2023, in force from 27.01.2023) organize the approval of the business program of the public enterprises from the MRDPW system, monitor the implementation of the business indicators laid down therein and propose decision-making for improving the management of the public enterprises.
